Any order for a Product offered on the Site requires the review and explicit acceptance of these general terms of sale, without this acceptance being conditional on a handwritten signature from the User.
It is specified that the User may save or print these general terms of sale, provided they do not modify them.

2- PRODUCTS SOLD – ORDER TERMS - PURCHASES
The website www.fleurnabertcreations.com allows users to order a selection of Fleur Nabert créations brand products directly online via the Internet from France.
Fleur Nabert créations products ordered on the Site may be shipped worldwide.
For each product selected on the website www.fleurnabertcreations.com, a summary page will automatically appear, showing the item's photo, available colors and reference numbers, its variants, the selected quantity, its unit price, and the total cost of your order. You must verify the accuracy of your selection before confirming your order. Upon confirmation, your order will be sent to Fleur Nabert créations for processing.
While every effort is made to ensure that the color and design of Fleur Nabert créations products whose photos are displayed on the website www.fleurnabertcreations.com match the original products, variations may occur, particularly because all items are handcrafted and some use natural flowers; these minor differences make each piece of jewelry unique. In addition, color rendering technologies on your personal devices may also cause differences between the web photo and the received product. Fleur Nabert créations reserves the right to cancel any order from a customer with whom it has an outstanding dispute relating to a previous order, or if Fleur Nabert créations reasonably believes that this customer has violated these General Terms, engaged in fraudulent activity, or for any other legitimate reason.
GIFT CARD
The Digital Gift Card may only be ordered on the e-commerce website www.fleurnabertcreations.com. It is a digital item, sent by email and loaded with the amount selected by the customer at the time of online ordering.
The amount loaded onto the digital gift card, which is accessed via the code sent by email, may only be used online exclusively at www.fleurnabertcreations.com, and must be spent in a single transaction. The digital gift card is valid for 1 year from the date of online purchase.
The digital gift card is not subject to VAT in accordance with articles 256 ter and 266 of the French General Tax Code. Any online order paid for using a gift card as a payment method will be subject to VAT, as required by the applicable regulations of the order's delivery country.
The digital gift card is non-transferable, non-refundable, non-reloadable, cannot be exchanged for cash, or credited to a credit card. The digital gift card does not grant any usage rights at physical retail locations or partner stores, in France or abroad. Its purchase and use are exclusively reserved for the e-commerce website www.fleurnabertcreations.com.
The digital gift card code must be entered in the "Promo Code" section at checkout, before completing your order. Once the code is entered, the customer may choose to pay the remaining balance online to validate their order, or use the exact full amount of the card. Orders placed online using a gift card as a payment method do not exclude potential shipping costs, and are subject to VAT and customs fees, depending on the order's delivery location.
3- AVAILABILITY – PURCHASES
Our product offers and prices are valid as long as they are visible on the site, while stocks last. Errors or modifications may exceptionally occur, particularly in the case of simultaneous orders for the same product from multiple customers. In the event that a product becomes unavailable after your order is placed, we will notify you by email or phone as soon as possible, offering you the option to order another item featured on the website www.fleurnabertcreations.com as a replacement, or to cancel your order. If you choose to cancel your order, you will be refunded no later than 30 days after payment if your bank account was debited.
Fleur Nabert créations accepts no liability for stock shortages or product unavailability.

4- ORDER VALIDATION – PURCHASES
At the end of the checkout process, you will be prompted to click the "Pay" button. Upon validation, your order is sent to Fleur Nabert créations for processing. It may only be modified or canceled under the conditions explicitly outlined in these General Terms of Sale or as required by applicable law. Placing an order for any product featured in the online store on the website www.fleurnabertcreations.com requires prior review and acceptance of these general terms of sale. Clicking to validate the order constitutes full acceptance of these terms. A summary of your order will be sent to you by email.
Data recorded by the website www.fleurnabertcreations.com constitutes proof of all transactions completed between Fleur Nabert créations and its customers. In the event of a dispute between Fleur Nabert créations and any customer regarding a transaction made on the website, the data recorded by Fleur Nabert créations is considered irrefutable proof of the transaction's content.

5- PRICING AND PAYMENT - PURCHASES
All product prices are listed in euros, all taxes included, excluding shipping fees (see the shipping and delivery section). All customs fees related to your shipment are your sole responsibility. The Site reserves the right to modify its prices at any time without notice. Products will be invoiced based on the rates in effect at the time the order is registered. Products remain the property of www.fleurnabertcreations.com until full payment of the purchase price is received by the seller. The full purchase price is due in a single lump-sum payment.

All orders placed on the www.fleurnabertcreations.com must be paid immediately after your order is validated. All orders are payable in euros.
We only accept payments by bank card or credit card. Accepted bank and credit cards are: MasterCard®, Visa®.
We do not accept any payments by check.
Your order will only be shipped after we verify your payment method and receive authorization to debit your card.
In the event that some ordered items are unavailable (see Availability), only the price and shipping fees for the available products will be charged.
6- PAYMENT AND SECURITY
Payment for purchases may be made at the customer's choice:

Bank card payments are therefore fully secure. Your order will be registered as soon as the banking service accepts the payment. Your credit card details are encrypted via the SSL (Secure Socket Layer) protocol and are never transmitted in plain text over the network. Payment is processed directly with your bank. The seller never has access to these details, and does not store them on its servers. This is why you are required to re-enter them for every new transaction on our site.
We use this clause to inform you that our website will never send you communications, by email or any other method, to request your banking details.
7- FRAUD PREVENTION
The Site reserves the right to verify the validity of payment before shipping an order, by any means the seller deems necessary (including requesting proof of identity, proof of address, etc.). The company Fleur Nabert créations also reserves the right to refuse to ship an order or fulfill any order from a customer who has not fully or partially paid for a previous order, or who has an ongoing payment dispute with the company. In the event of fraud or suspected fraud, the seller reserves the right to remove any member account without prior notice or compensation.
8- RETENTION OF TITLE – PURCHASES
Ordered products remain the property of Fleur Nabert créations until full payment of the purchase price is received by Fleur Nabert créations. In the event of a payment issue, you agree to return all received products to Fleur Nabert créations, upon first request, at your own cost.
However, you assume all risks (including loss, theft, breakage, or damage) for delivered products starting on the effective date of delivery.
9- DELIVERY ZONE - SHIPPING AND DELIVERY
The Site ships orders within 24 to 72 hours, Monday through Friday. Sale and promotion periods may cause a slight additional delay. Orders placed on a Saturday, Sunday, or public holiday will be processed on the next following business day.
Fleur Nabert créations products ordered on the Site may be shipped worldwide. For security reasons, among others, the company Fleur Nabert créations will not process any order that provides a PO box or Cedex address as a delivery location.
Products are shipped to the delivery address you provided during the checkout process. The website www.fleurnabertcreations.com is in no case liable for errors in the submitted delivery address or any potential loss of your package by the carrier. All lost or mislaid packages will be fully refunded.
10- SHIPPING AND DELIVERY - TRANSPORT FEES
Orders are shipped within 24 to 72 hours, Monday through Friday.
For jewelry, deliveries in France are made via La Poste tracked mail, with a shipping contribution
- of 3.90 euros for items up to 100g.
- of 6 euros for items up to 250 g.
- of 8 euros for items up to 500g.

Delivery is free for all jewelry orders equal to or exceeding 119 euros; this does not apply to glass icons.
A Chrono13 delivery option is available for jewelry. Your order will be delivered to you before 1pm the day after it is picked up by Chronopost, with a shipping contribution - of 12 euros for items up to 500 g

A ChronoRelais pickup option is available for jewelry, with a shipping contribution - of 5.90 euros for items up to 1 kg

- For glass icons, deliveries in France are made in a protective padded box via Chronopost, with a shipping contribution of 15 euros.
For all other countries worldwide, delivery is handled by Chronopost, and the rate will be displayed after you enter your address, based on international tariff zones.
11- SHIPPING AND DELIVERY - DELIVERY TIMELINES
For France, average delivery time for La Poste tracked mail, from the date of shipment, is 48 to 72 hours.
A Chrono13 delivery option is available for jewelry. Your order will be delivered to you before 1pm the day after it is picked up by Chronopost.
For international shipments, delivery takes 3 to 7 days depending on the destination zone.
Deliveries are made to the address listed in the order confirmation email or order form.
All risks transfer to the buyer from the moment the products leave Fleur Nabert créations' premises.
In the event of damage during transport, a formal complaint must be submitted to the carrier within three days of delivery.
Delivery timelines are provided for informational purposes only; if they exceed the agreed timelines at checkout by more than 30 days, the sales contract may be terminated and the Buyer refunded.
Fleur Nabert créations cannot be held liable for actions of the carrier or any third party who receives the package. A package marked as delivered by the carrier immediately terminates the sales contract.
Fleur Nabert créations nevertheless undertakes to provide the buyer with all required documentation to hold the carrier liable.
12- SHIPPING AND DELIVERY – CUSTOMS FEES
Any order placed on the site with a delivery country (or region) outside of metropolitan France may be subject to customs duties. These duties are imposed by the regulations in force in the destination country. These taxes are the customer's responsibility and fall under their sole liability. The Site www.fleurnabertcreations.com is not required to verify or inform customers of applicable customs duties and taxes. Customers must consult the competent authorities in their country before placing an order. If the recipient refuses to pay applicable customs duties or taxes, any sums charged to Fleur Nabert créations to recover the package will be deducted from the total refund issued to the customer.
13- SHIPPING AND DELIVERY - DELIVERY ISSUES
If your package is delayed or tracking is stalled. The buyer must contact Fleur Nabert création to report the issue via the website's contact form, including their name and order number. An investigation may only be opened with La Poste 15 FULL DAYS after shipment. This investigation must be opened by the buyer by calling La Poste at 36 31 from France, and by the seller to achieve the best possible outcome.
If the package is marked as delivered by La Poste, that means it was successfully dropped off. Fleur Nabert créations no longer has any way to trace the package and cannot be held liable in any way. La Poste will not accept any complaints once a package is marked as delivered. From experience, packages are often left with a neighbor or in an alternate mailbox. It is the buyer's responsibility to check locally for the package. If the package does not reappear within the legal timeframe of 30 days (for example, in the case of theft), the sale is considered canceled. The seller will refund the buyer to their original payment method, and the buyer may place a new order. If the original package arrives after the second order is placed, the buyer agrees to return the item to Fleur Nabert créations, as it has already been refunded, or to pay for it if they wish to keep it.
If the products you purchased are non-compliant, or you are not satisfied with them, you may return them or request a refund under the conditions outlined in the "Returns - Refunds" section.
14- RETURNS
Pursuant to article L121-20 of the French Consumer Code, the buyer has a period of fourteen working days from the delivery date of their order to exercise their right of withdrawal, and return the product to the seller for an exchange or refund without penalty, excluding return shipping costs.
For any return completed under this right of withdrawal, we recommend following this procedure:
The Customer must contact Fleur Nabert Créations via the contact form available on the website, specifying the reason for return, their name, order number, and return tracking number.
Fleur Nabert créations recommends that customers return their products:
- in packaging of identical quality to the original shipping packaging to prevent damage (damaged products will not be accepted for returns)
- and via tracked shipping to locate the return (or via registered mail, or if desired, with additional insurance that guarantees reimbursement of the products at their full market value in the event of theft or loss of the merchandise.
- Products must be returned in their original condition and packaging, at the buyer's cost, to the following address:

In all cases, returns are made at the Buyer's risk. It is the Buyer's responsibility to retain all proof of return. Returned products must be undamaged, in perfect resalable condition, in their original packaging. They must not have been worn or used, nor sustained any damage whatsoever, no matter how minor, and must be perfectly clean. Any product that is damaged or incomplete will not be refunded or exchanged.
Upon receipt of the return, we will verify the condition of the jewelry being exchanged before processing the exchange or refund
This right of withdrawal may be exercised without penalty, excluding shipping costs which remain the Buyer's responsibility. The Customer may also request a refund of all sums paid. The refund does not include original shipping fees or return shipping costs.
In the event of an error attributable to Fleur Nabert créations (defective item or order preparation error), Fleur Nabert créations will reimburse the return shipping costs for the item.
Under no circumstances will you be issued a store credit usable on the website www.fleurnabertcreations.com, and the site will not issue customer credits for use at any third-party store. We do not offer any refunds, even partial, if the product in question was received as a gift.
Fleur Nabert créations is the sole decision-maker regarding whether returned products are in their original condition when received at www.fleurnabertcreations.com
Exchanges are limited to one time only for the specific dizainier aux roses piece from the fine jewelry collection (silver, white gold, rose gold, yellow gold, champagne), as this model is produced exclusively to order.
15- WARRANTY AND REPAIRS
All handcrafted jewelry from the Maison Fleur Nabert créations undergoes rigorous inspection before shipping. The gold plating on the fittings that complete our products is sensitive to impacts and harsh cleaning products (soap, body wash, shampoo), which is why Fleur Nabert créations cannot guarantee against damage sustained from improper use. To extend the lifespan of your jewelry and preserve its original shine, we recommend taking great care of your pieces, including removing them for daily bathing, not wearing them in swimming pools or the ocean, and avoiding exposing resin pieces to excessive direct sunlight (UV tanning beds, beach days); store them in a dark, opaque jewelry box when not being worn.
Fleur Nabert créations jewelry is guaranteed for one year when used in compliance with the guidelines above, which are also detailed in the care guide included with your products. If a piece of jewelry is damaged despite following all care instructions, the buyer may contact the seller via the website's contact form, including their name and order number, to open an after-sales service case.
After the one-year warranty period, any damaged jewelry may be repaired at the buyer's request. The buyer may submit a photo via the website's contact form, and will be offered a paid repair package tailored to the specific issue.
16- LEGAL WARRANTY
Products sold on the Site are covered by the legal warranty conditions outlined in articles L 211-4, L 211-5 and L 211-12 of the French Consumer Code, as well as articles 1641 and 1648 of the French Civil Code.
17- LIMITATION OF LIABILITY
In no event shall the company Fleur Nabert créations be held liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of business, lost profits, or lost opportunities arising from the purchase of Fleur Nabert créations products on the website www.fleurnabertcreations.com, even if Fleur Nabert créations has been advised of the possibility of such damages.
18- WARRANTY DISCLAIMER
Fleur Nabert créations cannot guarantee or affirm that:
- the website www.fleurnabertcreations.com, is free of viruses, data-wiping programs, Trojan horses, or other destructive material;
- the information featured on the website www.fleurnabertcreations.com, is accurate, complete, or up to date.
Regarding access to the site, Fleur Nabert créations is only bound by an obligation of means, and cannot be held liable for any failure to access the Site.
The Site may contain technical inaccuracies or other defects; Fleur Nabert créations does not guarantee that these defects will be corrected. The Site and its content are provided "as is" and "as available". Fleur Nabert créations expressly disclaims all warranties of any kind, express or implied, including without limitation all implied warranties of merchantability or fitness for a particular purpose, or that the Site or its content do not violate any applicable regulations.
19- APPLICABLE LAW – DISPUTES – MEDIATION
These General Terms of Fleur Nabert créations are governed by and interpreted in accordance with French law, without regard to its conflict of law principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded by these terms.
In the event of a dispute, French courts have exclusive jurisdiction, and you acknowledge and accept their exclusive jurisdiction. Fleur Nabert créations reserves the right to seek and obtain injunctions or court orders to defend its rights under these terms.
